WAIVER OF
LIABILITY
The undersigned parent or
legal guardian of the child(ren) named below has enrolled that
child(ren) to participate in riding lessons, camps, programs and
recreational activities at our facilities, Stonewood Stables, Inc. Stonewood Stables, Inc. will
accept the child(ren) for participation only if the parent or legal
guardian accepts certain responsibilities for him or herself and/or
the child(ren), and releases all persons and parties through whom
the programs are facilitated from liabilities under most
circumstances.
Signature below is required for participation in Stonewood
Stable, Inc.’s programs.
By
signing this document, the parent or legal guardian confirms that he
or she has authority to sign, has read the entire document, and has
understanding that the document waives certain rights of the
child(ren) and the person signing.
The
parent or legal guardian acknowledges that the child(ren)’s
participation is voluntary.
The undersigned further acknowledges that participation in
equine activities, swimming, athletics, and other forms of physical
recreational activities can result in personal injury. While Stonewood Stables,
Inc. operates in a reasonable and safe manner, the undersigned
acknowledges that many of the activities in which the child(ren)
will participate will involve physical activities which inherently
may result in physical injury even if the program is conducted with
appropriate levels of care and supervision.
Under Georgia law, an equine activity sponsor or
equine professional is not liable for an injury to or the death of a
participant in equine activities resulting from the inherent risks
of equine activities, pursuant to Chapter 12 of the Title 4 of the
Official Code of Georgia
Annotated.
The
undersigned expressly acknowledges that neither Stonewood Stables,
Inc., nor any of its employees, agents or other representatives can
be responsible for any injuries to person or property arising out of
participation of the child(ren) in any program. In consideration of the
benefits to be derived by the child(ren) and the undersigned from
participation by the child(ren) in the activities, the undersigned,
on behalf of him or herself and the child(ren) and any other person
who may have any rights to assert any claim on behalf of himself or
herself or the child(ren) with respect to injuries to the person or
property of the child(ren), hereby waives and releases any claims
for damages against Stonewood Stables, Inc. and/or its
representatives, employees, and/or any landholder arising out of
injury or damage to the person or property of the child(ren) and
hereby releases and forever discharges Stonewood Stables, Inc. and
its representatives, employees, and/or landholder from all actions,
causes of actions, suits, damages, judgments, claims and demands
whatsoever, in law or equity, which the undersigned or the
child(ren) or their respective guardians, representatives, heirs,
executors, administrators, successors or assigns may have against
Stonewood Stables, Inc. and/or its representatives, employees,
agents, and/or landholder arising out of the participation by the
child(ren) in programs and events facilitated by Stonewood Stables.
